INTRODUCTION

1. This Privacy Policy is developed by Clodoc health Private Limited, having its registered Door No III/ 407 Ugrapuram Areekode Post Kerala 673639 (“We” “Us” & “Clodoc”).
2. We have developed this Privacy Policy to explain the manner in which, we collect, use, store, share, disclose and protect the information obtained by us in connection with the use of our various services by the healthcare professionals and Clodoc users
3. We would like to expressly state that, it’s important you understand that by using or accessing our Clodoc Services, you allow us to collect, use, disclose, and retain your personal information and other information but we will never read or listen to the content you are sharing privately.
4. We assure you that this Policy provides the manner in which the information would be used and we will not use the information in any other manner. In the event you are of the opinion that any practices undertaken by us is not agreeable, you are requested not to proceed with the access or use of Clodoc Services.
5. Any dispute regarding this Policy is subject to the terms provided in the Terms of Use.
6. This Privacy Policy is part of, and governed by, our Terms of Use. This Privacy policy is made in accordance with the stipulations made under Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 under the Information Technology Act.

TYPES OF INFORMATION AND COLLECTION

1. Your use of Clodoc Services is subject to the registration with us as provided under the Terms of Services. Although you may be allowed to access our Clodoc Services without registration, such use or access with or without registration results in the collection, formation or development of various type of information.
   1. Registration Information- When you access or use our Clodoc Services, you are required to voluntarily give us personal information such as name, email, birth date, age, phone number and financial information and photos or videos. We assure you that this information would be displayed to the public only to the extent that you agree to publish. We will also obtain information containing in your device regarding the contacts and address of the people. Based on the services you avail, we might be legally mandated to collect certain other information such as Aadhar Details/PAN/Voter Id/Driving license and may be educational details etc.

      If you are a service provider, you may provide us additionally with identity verification documents, trade / professional qualifications and accreditations, registrations, certifications and licenses, insurance policies as well as bank account details in which you wish to be paid for the services you may carry out through Clodoc platform.

   2. Technical Information: When you use or access Clodoc Services, we may collect certain technical information about your computer, tablet or mobile phone. This may include the device information, Internet Protocol address, browser type, browser language, referring URL, files accessed, errors generated, time zone, operating system and other visitor details collected in our log files to analyze the trends, administer the website etc.
   3. Third Party Information-If you sign in to your Clodoc Services through third-party social media sites like Facebook, Twitter or any third-party platforms, you agree to give us on-going access to your personal information on such sites (e.g., your public profile, friend list, accounts you follow or who follows you, your email address, birthday, work history, education history, interests, current city, and video viewing). We may receive certain information about you which is stored on social media sites if users of those sites give us access to their profiles and you are one of their friends or connections, depending upon your settings on those sites.
   4. Usage Information: Your Access and use of Clodoc Services would result in formation of information about your location, your preferences in availing Clodoc Services and your participation in any promotion sponsored by us, or information you provide as a comment , you provide to the public though Clodoc Services .

      Some information is collected which will not be disclosed (except where we are legally mandated) but for your user experience with Clodoc Services such as the calls that we make to you or you make to us, surveys that you complete through Clodoc Services or based on our request etc. We will also collect Service history and other personal details or photographs or audio and visual messages that you shared. As for delivered status and service call information (length of the call, missed calls etc.), we believe they are important for other users and therefore cannot be canceled.

   5. Personal Information: As you use Clodoc Platform or Clodoc Services, you might provide certain information with respect your physical features, medical situation and other information which might be considered as Sensitive Personal Information as per IT Rules. The information collected from you by Clodoc may include Personal Information and/or Sensitive Personal Data or Information about you and/or your family members and/or your dependents such as medical and health records including but not limited to your prescription, test reports, past medical history, etc. We understand that the Personal Information and/or Sensitive Personal Data or Information is extremely private to you and/or your family members and/or your dependents and assure you that it will be used only for providing required healthcare services through Clodoc Platform as mutually agreed to be rendered by us, and as stated under this Policy. While using Clodoc Service, Clodoc may collect the Personal Information in the following manner in order to facilitate the services seamlessly through our empaneled healthcare professionals. You hereby consent to the collection of such information by Clodoc
      1. GPS Location Permission
         • Location is utilised to deliver labs and Medicine delivery at their home.
         • It is recommended that the User sets their location sharing ‘Always’ as it will help Clodoc to show you location specific data like availability of medicines, Lab tests and connects the users to the healthcare professionals available in their region.
      2. Images / PDF / Files Access Permission
         • To upload and store the medical prescription during a doctor consultation. This is an action performed by the User.
         • To download and store the prescription / lab reports of the User
      3. Camera Permission
         • To capture a picture of medical records during a doctor consultation or upload such records and store it under User’s profile.
      4. Audio Recording Permission
         • Required to facilitate VoIP calls for doctor consultations
      5. Storage Permission
         • To show/access Users files uploaded by the User/ lab test records/ prescriptions in Users phone.
      6. SMS Permission
         • To support automatic OTP confirmation, so that you don't have to enter the authentication code manually.
      7. Receive SMS Permission
         • This helps Clodoc to send the User reminders, order status, booking reminders related SMS.
      8. Access Wifi State Permission
         • This helps Clodoc to optimize Users experience based on the Wifi's strength and signals, especially for optimizing video consultations.
      9. Phone, Microphone Permission
         • This will allow Users to call healthcare professionals empanelled on Clodoc Platform
   6. Financial Information: As you know, while availing Clodoc Services, you are required to make payments and undertake financial transactions, we may collect, depending on the services various information which relates to your Bank Account, Credit Card details, Tax, account number, cuv Number, PAN, Transaction Authentication Number “TAN” and password, TAX certificates or any other income documents or financial documents. Financial details (e.g., income, expenses and/or credit history may be collected.
2. Apart from the categories of information detailed above, we might also request information as a part of compliance with legal norms or as a part of information connected with any particular services. This Privacy policy does not cover information collected through any other apps or websites (including websites you may access through the Clodoc Services ) or by any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Site. These other websites, apps or third parties may have their own privacy policies, which we encourage you to read before providing information through them. USE OF INFORMATION

1. We will not share the information without your consent. Some of the information collected by us under Clause II will be used for improving Clodoc Services and to:
   1. provide you with various features of Clodoc Services and their contents, and any other information, products or services that you request from us;
   2. obtaining behavioral pattern of the users for enhancing the performance of Clodoc Services
   3. provide maintenance or support services for users of Clodoc Services;
   4. undertake training and quality assurance;
   5. fulfill any other purpose for which you provide it;
   6. carry out our obligations and enforce our rights, including for billing and collection;
   7. To verify your identity with banking services;
   8. Notify users when updates are available, and of changes to any products or services we offer or provide through the registration information;
   9. to allow you to participate in interactive features or offers on our Clodoc Services.
   10. Enabling the services availed by you including third party services
   11. use your information to develop and display content and advertising (and work with third parties who do so) tailored to your interests and/or location and to measure its effectiveness.
2. Financial information is used for undertaking financial transaction and except for ease of providing service, we do not store the information nor do we undertake commercial utilization of your financial information.
3. That said, we will disclose the information, if it is mandated by any statutory or legal/regulatory entity.
4. We use the information to facilitate the payment transaction or report on these transaction
5. We may disclose aggregated information about you without restriction.
6. You are informed that as per the IT Rules, we require your consent to collect and deal with personal information, in the event you don’t have consent to the practices envisaged herein, we request you to discontinue the use of our services.
7. To ensure the activities under Clause III(1), we will be disclosing it to the following entities,
   1. our subsidiaries and affiliates;
   2. contractors, service providers and other third parties we use to support our business and who are contractually bound to keep your personal information confidential and only use it for purposes for which we disclose it to them;
   3. to a buyer or other successor to all or substantially all of our assets, or to the assets of any division related hereto, through merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer;
   4. to comply with any court order, law or legal process, including to respond to any government or regulatory request;
   5. to enforce our rights; or
   6. if we believe disclosure is necessary or appropriate to protect our rights, property, or safety, or those of others.
8. Unless mandated by law, upon termination of your account with us, we will purge all information with respect your account and collected under Clause 2
